Section 01 Acceptance of Terms

These Terms and Conditions ("Terms") govern your access to and use of the website located at fab.coach and any related services, content, and communications provided by Fab.Coach, operated by FAB COACH LLC ("Fab.Coach," "we," "our," or "us"). By accessing our website, starting a chat, submitting a form, or opting in to receive messages from us, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, please do not use our website or services.

Section 02 Our Services

Fab.Coach provides private executive presence coaching services, led by Fabiano Altamura, for individual leaders and teams preparing for high-stakes speaking moments. Services include strategy calls, private 1-to-1 coaching engagements, team workshops, and related consulting. The information on our website is provided for general informational purposes only. Specific coaching services are provided pursuant to a separate written agreement or engagement letter that describes the scope, pricing, timeline, and terms of that engagement.

Nothing on the website constitutes a guarantee of any particular outcome in any speaking engagement, business meeting, investor conversation, media appearance, or other high-stakes moment. Coaching is a collaborative process, and results depend in part on the client's own participation and preparation.

Section 03 User Information

When you contact us through our website, our website chat, or otherwise, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of any login credentials you use to access our services, and for all activity that occurs under your account. Notify us immediately at [email protected] if you believe your account has been compromised.

Section 04 SMS Program Terms

By opting in to receive text messages from FAB COACH LLC, you agree to the following SMS program terms. These terms apply in addition to, and do not replace, our general Terms and our Privacy Policy.

Program Name

FAB COACH LLC Text Messaging (Fab.Coach SMS).

Program Description

FAB COACH LLC operates an SMS program that sends text messages to subscribers who have provided prior express consent. Depending on the consent you provide, you may receive:

• Transactional and service messages. Replies to questions you send us through our website chat or by text, strategy call confirmations and reminders, session reminders, workshop confirmations, waitlist notifications, engagement updates, and account notices.
• Marketing messages. Occasional updates on new workshops, limited coaching availability, masterclass invitations, and educational content for leaders preparing for high-stakes moments, sent only to subscribers who separately opted in to marketing SMS.

Marketing and transactional consent are collected separately. You may opt in to one, both, or neither. Consent to receive SMS is not a condition of purchase or of receiving any product or service from FAB COACH LLC.

How You Opt In

You opt in through a clear, affirmative action, such as providing your mobile number in the chat widget on our website and checking one or both of the optional, non-preselected consent boxes shown in the chat (one for informational and transactional messages, and a separate one for promotional messages), or checking an optional, non-preselected consent checkbox on the booking form at fab.coach/contact. We record the date, time, and context of your consent. By opting in, you confirm that you are at least 18 years old and are the account holder or authorized user of the mobile number you provide.

Cancelling Your Subscription (STOP)

You can cancel the SMS service at any time. Simply text "STOP" to the phone number from which you received the message. After you send "STOP," we will send a single confirmation message acknowledging your unsubscribe request. Following this confirmation, you will no longer receive SMS messages from that program. If you are subscribed to more than one program (for example, both marketing and transactional), you may need to reply STOP to each program from the relevant number.

Rejoining

To rejoin an SMS program after you have unsubscribed, sign up again using the same method you originally used to opt in (for example, through the chat on our website or by submitting the form at fab.coach/contact), and we will resume sending SMS messages to you.

Carriers and Delivery

Carriers are not liable for delayed or undelivered messages. We make reasonable efforts to deliver messages promptly, but we cannot guarantee delivery times. Our SMS program is supported on most major U.S. carriers, including AT&T, T-Mobile, Verizon Wireless, U.S. Cellular, Boost Mobile, Metro by T-Mobile, Cricket Wireless, and Google Fi. Supported carriers may change from time to time without notice.

Message Frequency, Fees, and Rates

Message frequency varies based on your interactions with us and the type of program you have subscribed to. As always, message and data rates may apply for messages sent to you from us and to us from you, according to the rate plan you have with your wireless carrier. For questions about your text or data plan, contact your wireless provider.

Privacy

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties. Section 05 Acceptable Use

When using our website, website chat, or services, you agree not to:

• Violate any applicable law, regulation, or third-party right.
• Use the website or services to transmit any unlawful, fraudulent, defamatory, or harmful content.
• Attempt to gain unauthorized access to any portion of our systems, other user accounts, or any connected network.
• Interfere with or disrupt the integrity or performance of our website or services, including by introducing viruses or other malicious code.
• Use automated means to access or collect data from our website without our prior written consent.
• Reverse engineer, decompile, or otherwise attempt to derive source code from any portion of our website or services.
• Record, reproduce, or redistribute coaching session content, materials, or methodologies without our prior written consent.

Section 06 Intellectual Property

All content, design, logos, trademarks, service marks, text, graphics, coaching frameworks, methodologies, session materials, and software on our website and in our programs are the property of FAB COACH LLC or its licensors and are protected by applicable intellectual property laws. You may access and view the content for personal, non-commercial use only. You may not copy, modify, distribute, display, teach, or create derivative works from any content without our prior written permission.

Client work product created during an engagement (for example, speech drafts refined in session) belongs to the client. The underlying coaching methodology, frameworks, and proprietary content used to produce that work remain the intellectual property of FAB COACH LLC.

Section 07 Third-Party Links and Services

Our website may contain links to third-party websites or services that are not owned or controlled by Fab.Coach. We do not endorse and are not responsible for the content, privacy practices, or operations of any third-party site or service. Your use of third-party sites or services is at your own risk and subject to their own terms and policies.

Section 08 Disclaimers

Our website and services are provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, FAB COACH LLC disclaims all warranties, including without limitation any implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy of information. We do not warrant that the website will be uninterrupted, error-free, or free of viruses or other harmful components.

Coaching is a collaborative process that depends significantly on the client's own preparation, engagement, and follow-through. Fab.Coach does not guarantee specific outcomes from any engagement, including without limitation deal closures, funding outcomes, standing ovations, media coverage, or career advancement.

Section 09 Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall FAB COACH LLC, its officers, members, managers, employees, contractors, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, goodwill, business opportunity, or other intangible losses, arising out of or related to your use of, or inability to use, the website or services. Our total aggregate liability for any claim arising out of or relating to these Terms or the website shall not exceed one hundred U.S. dollars ($100), except where prohibited by law.

Section 10 Indemnification

You agree to indemnify, defend, and hold harmless FAB COACH LLC and its officers, members, managers, employees, and agents from and against any and all claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or relating to (a) your use of the website or services, (b) your violation of these Terms, or (c) your violation of any third-party right, including any intellectual property or privacy right.

Section 11 Termination

We may suspend or terminate your access to our website or services at any time, with or without notice, for any reason, including if we believe you have violated these Terms. Upon termination, your right to use the website and services will immediately cease. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and indemnification) will continue to apply. Termination of the website terms is separate from termination of any coaching engagement, which is governed by the engagement agreement between us.

Section 12 Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Washington, United States, without regard to its conflict of laws principles. You agree to submit to the exclusive jurisdiction of the state and federal courts located in Snohomish County, Washington for any dispute arising out of or relating to these Terms or your use of the website or services.

Section 13 Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page and, if the changes are material, provide a more prominent notice. Your continued use of the website or services after changes take effect constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you should stop using the website.
